Briefly, <br />survey work done during the sale of the property at 3765 <br />Watertown Road revealed that the lot line ran through the garage <br />on that property, and didn't follow the fence line boundary <br />historically accepted by both property owners. As a result of <br />legal action, the affected property owners have agreed to the <br />proposed lot line configuration, leaving the garage within the <br />boundaries of 3765, with a 6' setback, while leaving a 10' <br />setback for the house at 3745. There is a trade-off in lot area <br />that slightly favors the Butterfield property, with the net <br />result that each property including roadway will contain <br />approximately 5.02 acres. <br />Planniiig Commission Recommendation <br />At their May 21st meeting. Planning Commission reviewed the <br />proposed subdivision and voted 6 to 0 to recommend approval as <br />proposed, finding that this lot line rearrangement creates no new <br />lots but solves an existing problem for the property owners. <br />Staff Recommendation <br />Staff recommends approval per the attached resolution.
