A RESOLUTION GRANTING <br />VARIANCES TO <br />HUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) AND <br />SECTION 10.03, SUBDIVISION 14 (C) <br />PILE #1589 <br />WHEREAS, Marcus and oudy Blue (hereinafter "the <br />applicants") are the owners of the property located at 2160 <br />Crystal Avenue within the City of Orono (hereinafter "City") and <br />legally described as Lots 7 and 8, BlocJc 2, Crystal Bay <br />Minnetcn)ca, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicants have applied to the City for <br />variances to Municipal Zoning Code Section 10.28, Subdivision 5 <br />(B) to permit the construction of an addition to the north side <br />of the house requiring approval of a side setback of 24' instead <br />of the required 30' and approval of a front street setback <br />variance for the structural repair of a deck located 8' from the <br />street lot line instead of t-he required 50'. Per the same zoning <br />code section, the applicant seeks variances for a garage addition <br />to be located 36' from a side street lot line instead of the <br />required 50' and 14'9" from the front street setback line instead <br />of the required 50'. In addition, applicants seek variances to <br />lot coverage allowance as proposed improvements result in total <br />structural coverage at 2,106.46 square feet, instead of the <br />allowed 2,100 square feet or 15%. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1589. <br />2. The propttrty is located in the RR-lB Single Family <br />Rural Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 17, 1990, and recommended approval of the <br />proposed variances based upon the following findings: <br />A) The house was placed on the property prior to <br />current zoning standards. <br />Page 1 of 4
