Zoning File 1590 <br />September 12# 1990 <br />Page 4 <br />As of this writing the City Engineer's review comments have <br />not been received but will be reviewed at your meeting. Cook's <br />comments will specifically address the location of the access. <br />Applicant had originally considered using an existing gravel road <br />located further south because of the condition of the road bed <br />and other conflicts with existing uses. Access directly off Old <br />Crystal Bay Road is sought by applicant. Cook will also provide <br />additional background on the possible impact of the proposed use <br />upon existing development. <br />Options of Action <br />A. Denial - Please refer to your necessary findings in Section <br />10.09, Subdivision 6. <br />B. Approval - Members may consider the following approval <br />recommendation - to approve a conditional use permit for a <br />stand-by supply of natural gas provided by a portable liquid <br />gas vaporizer for Minnegasco, Inc. at a property legally <br />defined as Lot 1, Block 1, Van Dale Addition, based on the <br />following findings: <br />1. Proposed location of this use within the City's <br />Industrial park meets the objectives of the Zoning Chapter <br />and purposes of the Industrial district in which the use is <br />located. <br />2. The proposed use was found to not be detrimental to the <br />public health, safety or welfare or materially injurious to <br />properties or improvements in the vicinity and will not have <br />a negative impact on the surrounding residential properties <br />because of its limitpd period of operation within the year. <br />The following conditions may be considered with this <br />approval: <br />Any changes in the hours of operation or expansion in the <br />period of operation (outside of cold weather months) shall <br />require an expansion of this conditional use permit or <br />possibly a new conditional use permit. <br />3. Resolve of fencing - issue of opaqueness. <br />4. This temporary conditional use permit is approved for a <br />period of 5 years. Applicant raust resolve permanent service <br />needs for this area of Orono within that period of time as <br />there is no guarantee that the City will grant another <br />conditional use permit for an extension of this use. <br />C. Tabling - A second public hearing to be scheduled before the <br />Planning Commission at their October 15, 1990 meeting.
