Lots 3 through 7 within Orono are residential and shall <br />be served by individual accesses off of Old Beach Road. Lot 8 <br />has been created along an existing B-4 zoning line and satisfies <br />all B~4 zoning standards. It is staff's understanding that Lot 8 <br />will be deeded to the Freshwater Foundation as well as Outlet A, <br />the wetlands outlet, so that Foundation can retain control over <br />the future use of the wetlands area. Review Mr. Jessen's letter <br />(Exhibit J). Jessen advises that if the Foundation does not <br />build upon Lot 8, that it will be offered to the University along <br />with Outlot A. The City will protect the outlet by requiring <br />flowage and open space easements oyer the entire wetland area. <br />In the original preliminary plan reviewed at the July 16, 1990 <br />public hearing, the applicant proposed excavations and filling <br />within a portion of Minnetonka Beach with compensatory <br />excavations within the City of Orono's wetland areas. This phase <br />of the application has been withdrawn. The Planning Commission <br />of the City of Minnetonka Beach granted unanimous approval of the <br />preliminary plat at their September 17, 1990 meeting. PlCdse <br />review the Orono Planning Commission minutes of September 17, <br />1990 for the Planning Commission's unanimous recommendation o^ <br />the plat as amended. Each of the residential lots meets th <br />required standards of the LR-lB zoning district. Although the <br />is extensive wetland involvement within the subject property, <br />each of the lots well satisfies the dry buildable contiguous <br />above the 932 wetland elevation as noted above. Lot 8 meets all <br />standards of the B-4 zoning district with 1.48 acres of dry land. <br />In reviewing the grading plans (Exhibit N), note that there is <br />adequate area within each defined building envelope. You should <br />also note all proposed elevations for building sites are well <br />beyond the 26' setback from the wetlands elevation at 932. The <br />City has asked that each building site be provided with a <br />basement floor elevation because of the depth of the sewer lines <br />to serve the houses off Old Beach Road.
