There is no' additional land available to bring the lot�width or lot area into : <br /> conformity. � <br /> d. The only access to the basement of the existing home is substandard in width. <br /> e. Including the addition, at 5.6%, the proposed residence is below the structural <br /> lot coverage limitation of 15%. � . <br /> f. The proposed addition complies with the front and rear yard setback � , <br /> requirements. <br /> g. The lot is pie shaped and narrower as it approaches the street. The existing <br /> home does not meet the 30' side yard setbacks. In order to meet the 30' <br /> � � setback on both side yards the home would need to be situated at least 80' � <br /> from the street,which is out of character for the immediate neighborhood. <br /> . 4. The City Council has considered this application including the findings and ' � <br /> reconunendation of the Planning Commission, reports by City staff, conunents by . <br /> the applicants and the public, and the effect of the proposed variance on the � <br /> health, safety and welfare of the community. . <br /> 5. The City Council finds that the conditions existing on this property are peculiar to . <br /> it and do not apply generally to other property in this zoning di'strict; that granting <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable . <br /> hardship or difficulty; is necessary to preserve a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the Zoning Code � <br /> and Comprehensive Plan of the City. , <br /> CONCLUSIONS, ORDER AND CONDITIONS � � , <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to allow a 22.5' side <br /> yard setback in order to construct a 5' x 24' addition to the existing home, subject to the <br /> • following conditions: • <br /> Page2of5 . . <br />
