The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 6. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owners, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owners; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> • CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, tlle Orono City Council hereby grants variances to Orono <br /> Municipal Zoning Code Sections 78-1279, 78-350, 78-1403 and 78-1288 to allow <br /> � consti-uction of a second story, wing wall, and attached garage for the existing residence, <br /> subject to the following conditions: <br /> 1. Council approval is based on the site and house plans submitted by the <br /> Applicants and a.imotated by City staff, attached to this Resolution as Exhibits <br /> A. and B. Any amendments to these plans may require further Planning <br /> Commission and City Council review. <br /> � 2. A fire lane shall be maintained across the property as generally shown on <br /> Exhibit C. The northwesterly side will be marked with Fire Lane signs and the <br /> � southeasterly side adjacent to the garage approach will be marked with <br /> contrasting paving materials. A fire lane and emergency vehicle access <br /> easeinent shall be provided over the fire lane. By signing this resolution the <br /> Owners agree to �rant this easement, which shall be created by a separate <br /> document. <br /> � 3. The proposed open entry porch and the open porch on the lake side of the <br /> house shall not be reconverted to enclosed space. <br /> , Page 3 of 6 <br />
