FINDINGS <br /> 1. This application was reviewed as Zoning File#06-3245 <br /> 2. The property is located in the LR-1C zoning district, where 0.5 acre is the <br /> minimum lot area and 100 feet is the minimum.lot width. The property is 0.26 <br /> . acre in area and 92 feet in width. <br /> 3. There is a roadway that provides access from this property and four others to <br /> North Shore Drive. This roadway has existed for over 50 years. It is <br /> maintained by the property owners who use it for access. While this roadway <br /> does not have the 50 foot right-of-way required for a private roadway and in <br /> • fact may exist only by prescription, it functions as a private roadway and <br /> should be considered one for purposes of determirung setback and lot area. <br /> This does not reduce the width of the lot but the area is reduced to 0.22 acre. <br /> 4. . The Planning Commission reviewed this application on November 20, 2006 <br /> and on a vote of 4 - 0 recommended approval of the variances, based on the <br /> following findings: <br /> a. The area of the lot is only 43 percent of the required minimum lot area. No <br /> land is available to enlarge the lot. The size of the lot is similar in size to <br /> the other lots in the immediate vicinity. <br /> b. The new garage will be placed so the width of the private roadway/fire lane <br /> at its narrowest point is increased from 15.2 feet to 18 feet. The new . <br /> garage is slightly larger than required to accommodate two vehicles to <br /> compensate for absence of a basement under the house. <br /> � c. The second story will resemble a half-story. The remodeled house will <br /> have less mass than a new 2%z story house constructed without a lot <br /> coverage variance. The portion of the house that encroaches on the <br /> average lalceshore setback will be changed from an enclosed room to an <br /> open porch. � <br /> • <br /> Page 2 of 6 <br />
