A RESOLUTION AMENDING <br />RESOLUTION #1985 <br />THAT GRANTED PINAL APPROVAL <br />OP THE BYPIBLD PLAT <br />PILE #998 <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, the City Council of the City of Orono has <br />adopted subdivision regulations for the orderly, economic and <br />safe development of land within the City; and <br />WHEREAS, on April 28, 1986 the City Council granted <br />final plat approval of a two-lot subdivision application of <br />Maureen S. Bellows (hereinafter the "subdivider") for a plat <br />known as the Byfield r>iat; and <br />WHEREAS, the City Council has considered a request of <br />the subdivider that would seek to amend a condition of plat <br />approval that would require a shared driveway access for Lot 1 <br />and Lot 2, Byf ‘Id and has asked for separate accesses at County <br />Road 146; and <br />WHEREAS, the Council has considered the written <br />comments of the Hennepin County Department of Transportation and <br />the written and oral comments of staff and noting the following <br />findings: <br />1. The Byfield plat provided 509 lineal feet of frontage <br />along County Road 146. Lota 1 and 2, Byfield satisfied the <br />required lot width to the rear of the front yard setback <br />area at 200'+ each. <br />2. The Byfield plat did not require ^ ariances to the <br />standards of the RR-IB, rural residential zoning district. <br />3. There is already an existing driveway access approved by <br />Hennepin County that serves Lot 2. <br />4. There is adequate sighting distance based on the 40 MPH <br />allowed speed for County Road 146 to provide safe access to <br />Lot 1. <br />NOW, THBREPORB, BE IT RESOLVED that the City Council of <br />Orono, Minnesota hereby aj-'^roves an amendment of Resolution #1985 <br />that granted approval of the Byfield plat that would allow <br />single/separate accesses to Lots 1 and 2, Byfield, Hennepin <br />County, Minnesota, subject to the following conditions: <br />Page 1 of 2
