gRONO <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. _________________ <br />A RESOLDTION DENYING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22r SUBDIVISIONS 1*2 AND <br />SECTION 10.55r SUBDIVISION 8 AND <br />DENYING A CONDITIONAL USE PERMIT <br />PER SECTION 10.03, SUBDIVISION 19 <br />PILE #1552 <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, pursuant to State Statute 412 et. seq. and 462 <br />et. seq., the City Council of the City of Orono has adopted <br />zoning regulations for the protection of the public health, <br />safety and general welfare; and <br />WHEREAS, Renee & Steven Foster (hereinafter "the <br />applicants”) are the owners of the property located at -800 <br />Shadywcod Road within the City of Orono (hereinafter the City ) <br />and legally described as follcws; <br />Lot 21, Shadywood, Hennepin County, Minnesota (hereinafter <br />”the property"); and <br />WHEREAS, the applicants have applied to the City of <br />Orono for variances to Municipal Zoning Code Section 10. , <br />Subdivisions 1 & 2 and Section 10.55, Subdivision 8 to allow <br />construction of retaining walls and additional hardcover in the <br />0-75' lakeshore setback zone where no structure or hardcover is <br />normally allowed, and for similar construction of walls and <br />hardcover in the 75-250' zone in excess of the 25% hardcover <br />normally allowed in that zone, and requesting a conditional use <br />permit per Section 10.03, Subdivision 19 to allow excavation n <br />the 0-75' lakeshore setback zone where no excavation is normally <br />allowed; and <br />WHEREAS, the City Council has reviewed the application, <br />the recommendations of the staff and Planning Commission, and the <br />comments and written statements of the applicants. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />Orono, Minnesota hereby denies the application as described above <br />based upon one or more of the following findings of fact <br />concerning this property; <br />Page 1 of 4
