3.
Currently, all vehicles are stored outdoors on the property as there is no
garage on the property and no sod or driveway has been installed.
The 35' setback could be met, however meeting this requirement would
result in a higher percentage of hardcover in the 75' to 250' lakeshore
setback.
5.
The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
sen'e as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plar. of the City.
The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoning Code Section 10.03, Subdivision 14(C), Section 10.22,
Subdivision 2 and Section 10.24, Subdivision 5(B) to allow construction of a detached garage
requiring a variance for hardcover of 5% in the 75' to 250' lakeshore setback to allow 30%
where 25% is allowed, a variance for structural coverage of 2.5% to allow 17.5% where 15%
is allowed and a variance for street yard setback of 15' to allow the garage to be located 20'
from the street lot line where 35' is required.
