3. <br />Currently, all vehicles are stored outdoors on the property as there is no <br />garage on the property and no sod or driveway has been installed. <br />The 35' setback could be met, however meeting this requirement would <br />result in a higher percentage of hardcover in the 75' to 250' lakeshore <br />setback. <br />5. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />sen'e as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plar. of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.03, Subdivision 14(C), Section 10.22, <br />Subdivision 2 and Section 10.24, Subdivision 5(B) to allow construction of a detached garage <br />requiring a variance for hardcover of 5% in the 75' to 250' lakeshore setback to allow 30% <br />where 25% is allowed, a variance for structural coverage of 2.5% to allow 17.5% where 15% <br />is allowed and a variance for street yard setback of 15' to allow the garage to be located 20' <br />from the street lot line where 35' is required. <br />Page 2 of 5
