'�'�,� ' �G� <br /> RESOLUTION OF THE CITY COUNCiL <br /> `�kEsH.og' No. .5 5 1 5 . <br /> A RESOLUTION GRANTING VA.RIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-350 & 78-1288 <br /> ' FILE NO. 06-3214 <br /> WHEREAS,Rudy Wicklander Homes, Inc., a Minnesota corporation(hereinafter <br /> "the applicant") is the owner of the property located at 3345 Crystal Bay Road within the City of <br /> Orono (hereinafter the"City") and legally described as follows: <br /> Lot 9, Wallace's Addition to the Village of Minnetonka Beach, Hennepin County, <br /> Minnesota(hereinafter the"property"); and <br /> WHEREAS, the applicant has made application to the City of Orono for <br /> • variances to Orono Municipal Zoning Code Section 78-350 to allow a lake setback of 58' where <br /> a 75' setback is required, a 10' side street setback where 15' is required, a rear yard setback of <br /> 10' where a 30' setback is required in order to construct a new single family home; and <br /> WHEREAS,the applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1288 to allow 1,140 s.f. or 38.11%within <br /> the 0-75' setback area where 0% is normally allowed and 931 s.f. or 51.38%within the 75-250' <br /> setback area where 25% is normally allowed in conjunction with the construction of a new single <br /> family home. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS .�° <br /> J <br /> 1. This application was reviewed as Zoning File 06-32�14. <br /> 2. The property is located in the LR-1C Lakeshore Residential Zoning District <br /> which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> July 17, 2006 and recommended approval of variances based on the following <br /> • findings: <br /> Page 1 of 5 <br />
