CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 g 0 0 <br />A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL OF A CLASS U SUBDIVISION <br />OF LOT 1, BLOCK 1, BELL KELLEY'S LAND <br />- FILE NO. 2426 <br />WHEREAS, George Stickney and J. O. Stickney (hereinafter the "subdividers ”) on <br />September 22, 1998, filed a formal subdivision application with the City for approval of a two lot <br />residential plat of property legally described as: <br />Lot 1, Block 1, Bill Kelley's Land, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono's Zoning and Platting Codes, the Orono <br />Planning Commission held a public hearing on October 19, 1998, at which time all persons <br />desiring to be heard concerning this application were given the opportunity to speak thereon, <br />and <br />WHEREAS, at their regular meeting held on November 23, 1998, the Orono <br />City Council considered this subdivision application noting the following facts and findings: <br />1. The property is located within the RR-IB, One Family Rural Residential <br />District requiring a two acre minimum of contiguous dry buildable land within <br />each lot. <br />2. The property contains a total of approximately 6.59 acres. The proposed plat <br />contains two lots exceeding the minimum lot area requirement as follows: <br />Lot 1 = 4.02 acres <br />Lot 2 = 2.57 acres. <br />3. Each lot has been tested by a licensed on-site evaluator and found to have <br />suitable soils for both a principal and alternate on-site sewage disposal system. <br />4. A driveway access is rently provided by an opening from Willow Drive <br />South for Lot 2. Am driveway access will be needed for Lot 1 from Willow <br />Drive South. The Pubiic Services Director shall approve a driveway cut for Lot <br />1 prior to the issuance of a building permit. <br />D <br />Page 1 of 4
