Proposal Meets <br />Yes No <br />■ Performance Security <br />Security in the amount of one hundred percent (100%) of the <br />\contract shall be the guarantee that the successful proposer will <br />complete with the contract as specified. Its term shall be from <br />execution of the contract until one year following completion of <br />installation of the system and acceptance by the City of Orono. <br />Acceptable security includes a performance bond, letter ot credit <br />or amount escrowed in a manner acceptable to the City. <br />Warranty <br />The successful vendor must furnish a written ''arranty, <br />countersigned by the manufacturer and guaranteed by aim/her, <br />stating that all system components provided, supi lied and <br />installed with be free from defects in workmanship aa - juipment <br />for a period of one (1) calendar year computed from th . date of <br />final acceptable by the City. If any portion of the installation <br />is not performing satisfactorily, equipment shall be replaced or <br />malfunction corrected at the City's request. <br />During a ninety (90) day period immediately preceding the end of <br />the said oris vear warranty period, all equipment must be <br />operating t:’ tne full satisfaction of the City, free from all but <br />normal maincenance. In the event of equipment failure or <br />malfunction occurring at any time during that ninety (90) day <br />period, the City may request the extension of the performance <br />bond for an additional twelve (12) months calendar period at no <br />additional expense to the City. Such request shall be based upon <br />the sev^ .'^•ity, history and nature of the failures of malfunctions. <br />The successful vendor shall further agree that he/she will, at no <br />expense to the City, repair and replace to the City's <br />satisfaction, all defective telecommunications* work and equipment <br />and any building damage cause thereby during the guaranty- <br />warranty period, or installation. <br />Service and Parts Guarantee <br />To nsure, insofar as possible, that local service, maintenance <br />ani. arts facilities will be available to the City 2f Orono the <br />equipment m£mufacturer must agree to enter into a legally binding <br />agreement with the City guaranteeing such availability. <br />Such agreement shall state that the manufacturer shall be liable <br />to the City of Orono for the sum of one hundred dollars ($100.00) <br />per calendar day for each and every day which no manufacturer <br />authorized service/maintenance representative is available in the <br />Minneapolis/St. Paul area, upon service require by the City. <br />Said agreement shall be drafted by the City Attorney. Agreement <br />shall be binding for a period of five (5) years following the <br />installation and acceptance by the City.
