A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTIONS 10.28, SUBDIVISION <br />AND 10.03, SUBDIVISION 14 <br />FILE 1581 <br />5 (B) <br />(C) <br />WHEREAS, Robert Foehnen (hereinafter "the applicant") is <br />the owner of the property located at 537 Hanlon Avenue within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Lots 4, 5 and 6, Bloc)c 14, Minnetonka Bluffs, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Sections 10.28, Subdivision 5 (B) <br />and 10.03, Subdivision 14 (C) to permit the construction of deck and a <br />gazebo, such improvements being located less than the required 50' <br />setback from the front street lot line, and such improvements <br />increasing lot coverage ahcve the 15% lot coverage limit normally <br />required. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota; <br />FINDINGS <br />1. This application was reviewed as Zoning File 1581. <br />2. The property is located in the RR-IB Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />August 20, 1990, and recommended approval of the proposed <br />variance based upon the following findings; <br />a) The deck and gazebo locations will not tend to be ouu of <br />character with this neighborhood of small lots, and will be <br />essentially in line with the front line of the existing <br />house. <br />Page 1 of 4
