LMCD BOARD OF DIRECTORS July 25, 1990 <br />Babcock raised the question of LMCD authority vs. City <br />authority. Grathwol responded there can be over-lapping <br />authority in some cases and in this case it is the conditional <br />use permit under which the Yacht Club is allowed to operate. <br />c) City <br />Worksheet (EAW) <br />of Deephaven Environmental Assessment <br />Grathwol moved, Foster seconded, to determine that an <br />Environmental Impact Statement is not needed, to recommend <br />approval of the Findings of Fact and Conclusion as submitted by <br />the Executive Director and approval of the new dock license and <br />special density license of the City of Deephaven. <br />The Executive Director reported the MN DNR comment that <br />no treated lumber is tc be used that would contaminate fish or <br />other aquatic organisms has been removed from the Findings of <br />Fact. The MN DNR understands treated lumber must be used and <br />will not have an adverse affect on the Lake. <br />The Executive Director explained the MN DNR comment <br />regarding development of a long-range plan for dock expansions <br />results from the unusual number of EAWs submitted in recent <br />months as a result of the moratorium. <br />Hurr asked who has the responsibility for covering the <br />costs of preparing an EAW. The Executive Director responded that <br />the EAW is the responsibility of the responding governing unit <br />according to E.Q.B. rules. He said the costs of preparing an <br />E.A.W. were not taken into consideration when permit fees were <br />established. <br />Motion for approval passed unanimously. <br />Hurr moved, Rascop seconded, to refer a study of the <br />E.A.W. application and deposit fees to the Water Structures <br />Committee. Motion carried unanimously. <br />d) Dock License Renewals <br />Grathwol moved, Boswinkel seconded, approval of the <br />following dock license renewals: <br />Crystal Bay Service, Crystal Bay, Orono <br />Harrison Harbor, Harrison Bay, Mound <br />Seton Twin Homes, Mound <br />noting Harrison Harbor is being back licensed for 1989. Late <br />fees are included for the renewals with Seton Twin Homes being <br />credited for the $25 fee they paid earlier when low water <br />prevented the use of the docks. A condition is to be placed on <br />the Crystal Bay Service license clarifying the terms of the <br />license as related to watercraft storage. Motion carried <br />unanimously.
