A RESOLUTIOH DENYIHG <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1556 <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, pursuant to State Statute 412 et. seq. and 462 <br />et. seq., the City Council of the City of Orono has adopted a <br />community management plan and zoning regulations for the <br />protection of the public health, safety and general welfare; and <br />WHEREAS, Mr. and Mrs. Gerald Nelson (hereinafter "the <br />applicants") are the owners of the property located at 1629 <br />Bohn's Point Road within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />Tract A , Registered Land Survey #565, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have made application to the <br />City of Orono for variances seeJcing approval of additional <br />structural hardcover witl i the 75-250' la)ceshore setback zone in <br />excess of the 25% hardcover normally allowed per Municipal Zoning <br />Code Section 10.22, Subdivision 2; and <br />WHEREAS, the City Council has reviewed the application; <br />the recommendations of the staff and Planning Commission, and the <br />comments and written statements of the applicant. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />Orono, Minnesota hereby denies the application, based upon one or <br />more of the following findings of fact concerning this property: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1556. <br />2. The property is located in the LR-IB Single Family <br />LakeshoreResidential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on July 16, 1990 and on a vote of 3 to 2 recommended denial <br />of the application based on the following findings: <br />a. Currently existing hardcover on the property <br />including the house, sidewalks, and driveway areas, <br />exceeds the hardcover limits previously approved for <br />this property in Resolution #1726, adopted by the City <br />Council on February 11, 1985. <br />Page 1 of 3
