Recodified Section 5.30 Including Proposed <br />Language <br />B. Transient Merchant Memo Dated 7/20/90 <br />ISSUE - Presentation to Council to determine whether they desire <br />to adopt the proposed language relating to transient merchants. <br />INTRODUCTION - At the Council's July 23, 1990 Council meeting. <br />Council directed that staff present language incorporating the <br />limitation as to definition for transient merchant. <br />DISCUSSION - Attachment A presents draft language for Section <br />5.30; <br />A) Modifies the definition of established place of business <br />to indicate there must be a building, the use of which is <br />subject to all applicable zoning ordinances. <br />B) Clarifies that business solicitation does not include <br />what is classified as transient merchant activity. <br />C) Limits transient merchants to a total of 10 days per <br />year. <br />Additionally, we have had an inquiry regarding "Flea Markets" in <br />which one person would work as a organizer and has merchants <br />coming in on a first come first serve basis. Our current <br />ordinance would require licensing of each individual seller. <br />Under both the current and proposed ordinances each vendor would <br />be required to obtain a license. This may make such flea markets <br />difficult for an organizer. <br />ALTERNATIVES - <br />1. Adopt the language as proposed.. <br />2. Amend and adopt. <br />3. Table for further consideration. <br />4. Take no action. <br />RECOMMENDATION - It is recommended that the Council adopt the <br />language presented in Attachment A. <br />■•n <br />, seconded by , that Council <br />set forth in ^Ftachment A and <br />approves the Official Summary for Publication.
