As a result of this review, the City <br />is considerin' 'ending the Ordinance as it relates to the <br />section on co3 cion of a fee from lots that were part of a <br />subdivision that had not previously paid a fee. In addition I <br />have asked for a revision to clarify the intended definition of <br />"maintenance", and possibly amend it to "capital improvement". <br />The intent was not to use funds for the operations of the park <br />but strictly to do significant capital repair together with <br />facility construction which is felt to have adequate legal <br />support, as does the relation of cash to impact of the <br />subdivision of the parks. The Park Commission will be reviewing <br />this at their September 4th Park Commission meeting. <br />The delay in response is regretted but deemed <br />appropriate in light of the significant issue you have rasied. <br />We appreciate your participation is this process. <br />Sincerely, <br />James R.
