Covenants or other equally effective legal instruments must be <br />developed that specify which lot owners have authority to use <br />the access lot and what activities are allowed. The activities <br />may include watercraft launching, loading, storage, beaching, <br />mooring or docking. They can also include other outdoor <br />recreational activities that do not significantly conflict with <br />general public use of the public water or the enjoyment of <br />normal property rights by adjacent property owners. Examples <br />of the nonsignificant conflict activities include swimming, <br />sunbathing or picnicking. The covenants must limit the total <br />number of vehicles allowed to be parked and the total number <br />of watercraft allowed to be continuously moored, docked or <br />stored over water, and must require centralization of all <br />common facilities and activities in the most suitable locations <br />on the lot to minimize topographic and vegetation alterations. <br />They must also require all parking areas, storage buildings and <br />other facilities to be screened by vegetation or topography as <br />much as practical from view from the public water, assuming <br />summer, leaf-on conditions. Such covenants are subject to city <br />approval. <br />N/A <br /> <br />Utilities <br />Stormwater Drainage Improvements <br />Stormwater facilities will be required in addition to payment of the City’s Stormwater Drainage Trunk fee. The <br />Developer has completed stormwater management and grading plans which are currently under review by the City <br />Engineer and the MCWD. Their stormwater management plan reflects grading and three stormwater infiltration <br />basins to address the stormwater resulting from the new hardcover of the development. All stormwater facilities, <br />basins, swales, etc. should be incorporated into drainage and utility easements on the Final Plat. <br /> <br />The developer will be required to make adjustments to their plans if directed by the MCWD or City Engineer. The <br />final, approved stormwater management and grading plans will be required as part of the Final Plat application <br />submittals. <br /> <br />Septic Systems + Wells <br />The developer has provided septic designs for each of the proposed lots. Individual septic system installation <br />permits are required in conjunction with building permits for the new homes. Private water supply wells should <br />also be sited with the building permits. <br /> <br />Fees <br /> Stormwater Drainage Trunk Fee <br />The stormwater drainage trunk fee (“SWDT fee”) will be determined by the City’s Fee Schedule at the time of <br />the Final Plat submittal. According to the current 2024 Fee Schedule, the development of a property within a 2- <br />acre residential zone requires payment of $8,060 per each new lot and/or development of a vacant lot. As <br />proposed, the developer will be subject to payment of a SWDT fee for 4 lots or $32,240*. <br /> <br /> Park/Trail Easement + Park Fees or Dedication <br />The Parks, Open Space, and Trail Plan chapter of the Orono Comprehensive Plan does not specify the need for a <br />neighborhood park at this location.
