Garage condos are not listed as a <br />permitted, accessory, or conditional use in the existing code language. As a result and following <br />Staff’s guidance, the Planning Commission gave direction for staff to pursue a text amendment <br />to consider garage condos as a conditional use within the Industrial district. The PC staff report <br />from that meeting are included as exhibits as part of this packet. <br />Proposed Language for review: <br />New Definition to be added: <br />Garage condo means a building or part of a building consisting of individual units for <br />indoor storage of motor vehicles, boats, trailers, or recreational vehicles and such items as <br />are customarily used for the care or upkeep of such motor vehicles, boats, trailers, or <br />recreational vehicles. Individual units are owned or leased and may be capable of <br />customization, alteration, or expansion by the owners or tenants of the units. Garage condos <br />may include common spaces or office areas. <br />New language proposed under the Conditional Uses section in the Industrial District: <br />(11) Garage condos, provided that: <br />a. No exterior parking or storage is permitted for a period longer than <br />twenty-four (24) hours. A parking plan must be provided to demonstrate <br />accessibility to the site. <br />b. The premises shall not be used or customized for residential living <br />purposes or community gatherings or events. <br />c. The premises shall not be used for the operation of a business or for <br />retail purposes, including but not limited to automobile repair. This does <br />not prohibit minor maintenance, care, or upkeep of motor vehicles, boats, <br />trailers, or recreational vehicles stored in individual units. <br />d. The management, use, and customization of the garage condos, <br />including common areas, and individual units, shall be governed by an <br />Application Summary: The City of Orono is proposing an ordinance to amend the Zoning Code <br />to allow “garage condos” by conditional use permit within the Industrial District. <br />Staff Recommendation: Planning Department Staff recommends approval. <br />269
