a. Because the property is generally rectangular and <br />contains lakeshore on two sides, more than half of the 1.17 <br />acre lot is in the 0-75' zone where no hardcover is normally <br />allowed. If the channel providing lake access to abutting <br />properties to the northwest had not been dredged at some <br />time in the past, this property with the proposed additions, <br />would not need a hardcover variance. <br />b. Hardcover in the 0-75' zone is 1.1%, with no additional <br />hardcover proposed in that zone. This provides a <br />significant area for filtration and absorption of run-off. <br />c. Applicant has agreed to remove specific items of excess <br />hardcover in the 75-250' zone, such that the existing 28.1% <br />hardcover in the 75-250' zone will only increase to 28.9%. <br />The proposed guest apartment and garage addition is located <br />so as to make use of existing driveway areas without adding <br />more driveway hardcover. <br />d. The proposed additions will have no impact on lakeviews <br />enjoyed by neighboring lakeshore property owners. The <br />entire existing house encroaches past the average lakeshore <br />setback line, and no new view obstructions will be created. <br />e. Council finds that the guest apartment as proposed will <br />meei- the intent of the guest apartment ordinance if the <br />proposed access door between the new garage and the <br />apartment is eliminated. This will make the lower level <br />access through the interior of the house function as the <br />primary access to the apartment. <br />f. The applicant's intent is to sell the house to his son, <br />Rick Brown, who will live year-round in the house. The <br />applicant and his wife will live in the guest apartment <br />during the 6 months each year that they spend in Minnesota. <br />g. The attached garage will provide for adequate parking <br />for the quest apartment. The design of the exterior of the <br />house will not appear as a duplex, but as a single family <br />residence. <br />h.
