A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 162, <br />AND GRANTING A <br />CONDITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.20, SUBDIVISION 3 (G) <br />FILE #1510 <br />WHEREAS, Richard W. Brown (hereinafter "the applicant") is <br />the owner of the property located at 2685 Shadywood Road within the <br />City of Orono (hereinafter "City") and legally described as follows; <br />Tract B, RLS 1453, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for <br />variances to Municipal Zoning Code Section 10.22, Subdivision 1, <br />to construct a residence addition nearer the lakeshore than the <br />defined average lakeshore setback line, where no encroachment is <br />normally allowed, and to Section 10.22, Subdivision 2 to <br />hardcover in excess of the 25% normally allowed within the 75- <br />250' lakeshore setback zone, and is requesting a conditional <br />use permit for a non-rental guest apartment per Municipal Zoning <br />Code Section 10.20, Subdivision 3 (G) ii. <br />Minnesota ; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1510. <br />2. The property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />April 16, 1990 and Hay 21, 1990, and on a 4 to 2 vote <br />r^ommended denial based on the issues of excess hardcover and <br />unacceptable primary interior access for the guest apartment. <br />4. The City Council reviewed this application on June 11, 1990 <br />and voted 4 to 1 i*. favor of conceptual approval of the requested <br />variances and conditional use permit, based upon the following <br />findings ; <br />Page 1 of 7
