CITY <br />OF <br />ORDNO <br />City of OROIXO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.2738 <br />The City Council has consi«3ered this application <br />including the findings and recommcjndations of the Planning <br />Commission, reports by City staff, comments by the <br />applicants and the effect of the proposed variance on the <br />health, safety and welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicants; and would be in keeping v’ith the spirit <br />intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants a variance to Municipal Zoning <br />Code Section 10.03, Subdivision 9 (A) to permit a pool and <br />storage structure to remain on the property without a principal <br />residence, subject to the following conditions; <br />1. Applicants are to provide proof of current insurance <br />coverage for the City of Orono's official recorcs throughout <br />tih ^ duration of^tT>js—.va?;^ance approval._________________________^ <br />2. An approved permanent covering must be installed over <br />^he water retention area of the pool by April 1, 1-90^_____ <br />3. If an application for a building permit a new <br />residence has not been realized by September 1, <br />pool structure and storage structure ^^^t be removed within <br />30 days of the deadline date (October 2, 1990). a <br />12.05, Subdivision 1 (A) of the Municipal Cooe, a <br />Certificate of Occupancy must be issued for the resia^ce <br />within 24 months of the issuance date of the building perm u <br />for the principal structure on the property. Per Section <br />12.05, Subdivision 2 (B), applicants are ^ <br />that all exterior construction must be completed vith^n one <br />year from the issuance date of a building permit .or the <br />principal structure on the property. <br />Page 2 of 5
