CITV- - <br />.OHONCt <br />City of OROIVO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2733_ _ _ _ _ <br />A <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (A) <br />FILE #1476 <br />WHEREAS, David & Suzanne Prass (hereinafter "the <br />applicants") have an interest in the property located at 1065 <br />Linden Lane within the City of Orono (hereinafter "City") and <br />legally described as follows; <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a <br />variance to Municipal Zoning Code Sectio’^ 10.03, Subdivision 9 <br />(A) to permit a pool and storage s‘*--ucture to remain on the <br />property that no longer contain.® a principal residence.^ The <br />former residence was removed as " result of a hazardous bui.;: ing <br />action initiated by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1476. <br />2. The property is located in the LR-IB Single Family <br />La)ceshore Residential Zoning District requiring 1 acre in <br />area. The property consists of 1.4 acres. <br />3. The Orono Planning Commission reviewed this application <br />on November 20, 1989, and recommended approval of the <br />proposed variance based upon the following findings; <br />A) The pool structure is sound requiring only cosmetic <br />repair. <br />B) The residence was removed in October 1988 and had <br />not been inhabited for approximately 2 years before <br />that time. The pool area has not had daily supervision <br />for over 3 years. <br />C) The property exceeds the required 1 acre in area <br />and 140' width standards, and can legally sustain a <br />principal residence without the need for further <br />variances. <br />Page 1 of 5
