Reduce the hardcover in the 75 to 250 foot zone to <br />approximately 47%, by removing existing hardcover. <br />It should be noted that the adjoining landowners consent to <br />this plan, and Ms. Kelly will stipulate that no further <br />construction will occur on the deck surface, other than normal <br />maintenance. <br />As the drawing indicates, the proposed deck will consist of <br />an upper level extending from the residence, and cantilevered over <br />a lower deck. The lower deck will be approximately three steps <br />down from the upper deck. The lower deck will be 30 inches off the <br />ground on the upper portion of the hill, and no more than 42 inches <br />off the ground on the lower portion of the hill. There will be an <br />angular staircase from the lower deck to the ground, consisting of <br />three or four steps, with a landing of no more than 30 inches from <br />the ground. <br />It is our intent that this revised plan meets all existing <br />Orono City Ordinances, a*‘id, in particular, the average lakeshore <br />setback requirement, as contained in Orono Code Section 10.22. <br />This section provides; <br />Subdivision 1: Lakeshore setback regulations. <br />The setback from the shoreline for lakeshore <br />lots shall be at least 75 feet and no building, <br />fence oi wall over 42 inches, but not in excess <br />of 72 inches in height above original grade may <br />be located closer to the shoreline than the <br />average distance from the shoreline of existing <br />residence buildings on adjacent lots. <br />This Ordinance, adopted on February 5, 1985, clearly prohibits <br />improvements which are ever 42 inches m height and extend p vft the <br />average lakeshore setback line. The upper level of the proposed <br />deck, which exceeds 42 inches in height, only encroaches upon the <br />lakeshore setback line by approximately one foot. See survey <br />previously' submitted in this matter. The lower deck, however, does <br />not fall within the requirements of this Ordinance because it is, <br />at its highest point from the ground, 40 to 42 inches off the <br />ground. Thus, the Ordinance has no affect on the lower deck, or <br />the angular staircase from the lower deck to the ground. <br />The only variance required for this Ordinance is foi the one <br />foot encroachment by the upper deck.
