Kelly <br />Zoning File Number:1452 <br />Dear Council Members: <br />We represent Ms. Jacquelynn M. Kelly in her application to the <br />City Council for zoning variances. We have reviewed the Staff <br />Report, Planning Commission Minutes, and the City Council Meeting <br />Minutes. Noting the concerns of the Staff, the Planning Commission <br />and the City Council, we present the following revised plan. <br />First, we want to clarify the fact that Ms. Kelly is the sole <br />owner of the property in question. Mr. James Klein does live on <br />the property. He was involved in constructing the existing deck <br />with another individual. Mr. Klein was tagged for commencing <br />construction without a permit, and also continuing construction <br />after a stop work order was issued. These matters against <br />Klein are presently pending and will be resolved through the prop <br />channels. It is my desire that Mr. Kl< in's activities do not ser. <br />to wrongfully prejudice Ms. Kelly's application. <br />Ms. Kelly amends her application by agreeing to make the <br />changes as drawn on the enclosed architect sketch on the exterior <br />deck retrofitting. As this drawing indicates, and incorporating <br />changes which were previously agreed to, Ms. Kelly amends her <br />application as follows: <br />1. Bring the deck into conformance with the 10 foot side <br />setback requirement. <br />2. Bring the deck into conformance with the 75 foot <br />lakeshc^c setback requirement. <br />3. Reduce the hardcove*' in the 0 to 75 foot zone to 0%.
