environmental protection <br />Like the 509 Plan, the coverage of the Environmental Protection <br />Program of the LMCD Plan goes beyond the 1,000 foot shoreland <br />district to include the entire upper drainage district. <br />The intent of the Environmental Protection Program is to <br />implement development controls that will inhibit the inevitable <br />decline in water quality and the functional values of wetlands. <br />This program reiterates many of the objectives as the 509 Plan. <br />The Environmental Protection Program, however, is divided into <br />three areas: water quality, wetlands and fisheries. <br />The majority of water quality and wetland provisions appear to be <br />consistent with the City's stormwater Management Plan and <br />existing Shoreland Ordinance. Specific items of note that are <br />not covered or are somewhat different than the City's current <br />plans and ordinances, but are stated within the LMCD Plan, <br />include the following: <br />o On site or regional detention of stormwater runoff shall be <br />required for developments in any land use category, <br />regardless of impervious surface area, if its stormwater <br />runoff would be discharged directly into a lake or to a <br />stream discharging to the lake. <br />Comment: The City's Stormwater Management Plan encourages <br />the maximum use of stormwater storage potential within the <br />City, however, this statement in conjunction with the <br />Stormwater Plan's detention areas should be reviewed for the <br />consistency with the LMCD Plan. <br />o The LMCD shall work with lakeshore communities to adopt <br />comprehensive lawn fertilizer and pesticide ordinances. <br />o The LMCD shall encourage lakeshore communities to use grant <br />programs or other means to ensure the perpetual protection <br />of wetlands through acquisition. <br />Comment: This could be a substantial undertaking for <br />wayzata as many of the wetlands within the City are on <br />private property. If wetland acquisition is to be pursued, <br />wetlands of most significance and the greatest potential of <br />being disturbed should be identified and a priority list <br />should be developed. <br />The fisheries aspect of the LMCD Plan is to be <br />out by the DNR and the LMCD. Its provisions do not pose direct <br />concern to the City of Wayzata.
