zoning File #1502 <br />March 14,1990 <br />Page 3 of 4 <br />The applicant has not submitted elevations for the proposed <br />building. The applicant has no definite plan at this time. He <br />advises that it was his original intention to move a house from <br />Bayside Poad to this site but that is no longer feasible. Sewer <br />has been assessed and a stub is available for connection to <br />sanitary sewer. <br />As noted above, the 5' fence cannot be located within the <br />defined 25' easement area along the south lot line. A 3' high <br />structure can only be placed 30' from the intersecting curb lines <br />of Prospect Avenue and Briar Street to maintain safe sighting <br />distance at the intersection.It should be noted that two other <br />homes are located on Prospect Avenue.The one facing Briar <br />Street achieves access off Briar Street.The one to the rear <br />uses Prospect Avenue.Access to the proposed house will be from <br />Briar Street.Applicant is advised of the need to review the <br />access location with the Public Works Department prior to the <br />issuance of a building permit for the new construction. <br />Applicant's application lists hardships noting that it is a <br />sewered area requiring 2 acre standards for a neighborhood that <br />contains predominately 1/2 acre to 3/4 of an acre lots. <br />There are delinquent real estate and special assessments <br />against the property that must be paid prior to the City issuing <br />a building permit. The City must be in receipt of proof of <br />payment by the County upon the issuance of a building permit. <br />The applicant should also be advised that there is approximately <br />$6,825.84 incurred by the City as a result of the hazardous <br />building action. This fee is in the process of being assessed <br />against the property. Applicant will have the opportunity to <br />pay this off prior to the formal assessment ordered by the <br />courts. <br />An approval recommendation for this variance application <br />must include the following conditions: <br />1.Prior to issuance of a building permit by the City for <br />the new construction applicant must provide proof from the <br />County that delinquent real estate taxes and special <br />assessments have been paid. <br />2.New driveway access off of Briar Street must be reviewed <br />by Public Works Director prior to the issuance of a building <br />permit. <br />3.Connection of municipal sewer prior to the issuance of a <br />Certificate of Occupancy.
