Zoning File #1502 <br />March 14,1990 <br />Page 2 of 4 <br />History of Property - <br />The original house on this property was razed by the City in <br />the winter of 1989 as a result of a hazardous building action. <br />There is no record of the actual location or setbacks for the <br />former residence. Access to the original home was achieved via <br />Prospect Avenue. Based on staff's recollection after several <br />visits to this site, the setback of the original structure was <br />approximately 10' from Prospect Avenue. The original structure <br />appeared to be 50'+ from the traveled road of Briar Street. <br />In 1985, a conditional use permit was issued by the City <br />during the sanitary sewer project for the Crystal Bay <br />neighborhood. Review Exhibit C, note that Briar Street does not <br />connect from Crystal to Prospect Avenue. As a condition of <br />granting an easement for Briar Street through the properties, tne <br />City agreed to do certain filling and drainage Improvements for <br />the affected neighbors. There is a recorded agreement for the <br />property to the immediate north enclosed in your packets (review <br />Exhibit I). In that agreement, an underground drainage tile and <br />catch basin was installed adjacent to the north line of the <br />subject property (review Exhibit M). A conditional use permit <br />for the subject property involved the filling of the north yard <br />area to provide gentler grades draining northward to the catch <br />basin at Briar Street or to the northwest corner of the property <br />to the catch basin on the adjacent property. The neighbor to the <br />north now voices concern that drainage from this new house will <br />impact the property. The applicant has been advised to submit <br />drainage plans for the new construction. It should be noted that <br />the property always drained to the north and after filling of the <br />property, the velocity of drainage was reduced by graduating the <br />slopes. The City may wish to condition approval on the City <br />Engineer's review of the final drainage plan. The applicant's <br />surveyor will have drainage plans for review at the Planning <br />Commission meeting. <br />Review of Current Application - <br />It is unfortunate that the City has no record of the exact <br />location of the former residence, but it is apparent to staff <br />that the proposed side street setback of the new residence would <br />be placed further from that side street setback line at <br />22'. The 30' setback is satisfied at the north side lot line. <br />The 50' street setback is met from the easement line. Note that <br />in formally approving the area variance, we must exclude the road <br />easement portion cf the property.
