Island. . <br />Page 39. Authority - While laudable in intent the assumption is <br />still that the Water Patrol is the only law enforcement agency <br />that will be allowed on the lake. The rationale for this <br />assumption is not specifically stated. While the City of Orono <br />does not necessarily desire to have any lake patrol, it would <br />like to be able to contract to provide enforcement of violations <br />that its officers sees on the water from the land and be able to <br />enforce those regulations which the City currently is not able to <br />do. Additionally it would like to, during the winter months, <br />when it is frozen over, have the ability to d al with those types <br />of violations when it is able to go out on the "water". <br />Additionally there are times that the Water Patrol has no one on <br />duty at present in the summer from 11:00 o'clock at night to 8:00 <br />in the morning, at which a workable solution for putting law <br />enforcement presence on the lake would be beneficial. If there <br />is a concern as to the amount of jurisdiction the City would <br />obtain, it could be easily handled in the contract arrangement <br />between LMCD and the cities. This contract enforcement would <br />include addressing not only to enforcement of LMCD regulations <br />generally handled by the Water Patrol but other types of <br />regulations that LMCD's inspectors handle such as docks and <br />related land use. <br />The statement that the POST ’Joard (Police Officer Standards of <br />Training) effectively determine the number of full and part time <br />positions is not only substantially misleading but for the most <br />part incorrect. The only thing that the POST Board does is <br />indicate the credentials that someone must have to be employable <br />and some restrictions on the number of part time postions that a <br />unit can have in relationship to its full time positions. <br />The entire discussion still fails to come to grips with the <br />land/water interface and enforcements within those zones. <br />Presently there are problems that could well be handled if <br />certain "parochial" interests would allow LMCD to contract <br />selected enforcement powers in selected circumstances to the <br />cities. <br />IV. SHORELAND PROTECTION <br />Page 47. Perspective - While there seems to be a common <br />understanding of the LMCD's jurisdiction at 929.4 on the lake, <br />when the discussion involves LMCD's control of wetlands below
