P.A. <br />yashinoton only <br />The Honorable Mayor Grabek and <br />Members of the City Council <br />City of Orono <br />1335 South Brown Road <br />Orono, MN 55323 <br />Re: City Council Agenda Items for Tuesday, May 29, <br />1990: Mark and Karen Cuff Drainage Problems <br />The Honorable Mayor Grabek and Members of the City Council: <br />Our firm represents Mark and Karen Cuff of 3572 <br />Livingston Avenue, legally described as Lot 16 and 17, Block <br />3, Navarre Heights (collectively referred to as "Property”). <br />The purpose of this letter is to set forth the facts <br />supporting the Cuff's request that the City commence <br />assessments to fund the construction of storm sewer <br />improvements, which will alleviate wat.^> drainage problems <br />on the Property and adjacent properties. <br />In 1982, at the suggestion of JoAnne Ellen Herr of the <br />Orono City Council, Tom Jacobson former Orono City employee, <br />and members of the City planning staff, Karen Cuff purchased <br />Lot 17 from Hennepin County. Councilwoman JoAnne Herr, the <br />planning staff and Orono City employees made representations <br />that Lot 17 was buildable and that there would be no problem <br />in obtaining a building permit. Hennepin County was placing <br />Lot 17 up for auction and it was the City's desire to have <br />the Cuff's purchase the lot instead of a prospective <br />developer. The lot was undersized and any development would <br />have required a variance. In order to avoid a variance <br />application the City suggested that Ms. Cuff purchase Lot <br />17.
