Gerhardson, Public Works Director <br />Date: May 25, 1990 <br />Subject: Drainage Problem ~ 3572 Livingston Avenue <br />Mark and Karen Cuff <br />52590.5HD <br />In 1989, the City of Orono received a request from Mark and <br />3572 Livingston Avenue, to assist them in correcting <br />a drainage problem so that they may construct an addition to <br />their home. After several meetings and feasibility study, the <br />matter was tabled to allow the Cuffs additional time to perform <br />soil testing to determine contamination to the soil as a result <br />of the run-off from the neighborhood to the Cuff's property. <br />The Cuffs have performed the testing which is inconclusive <br />regarding contamination and have now hired an attorney to help <br />them convince the City to perform a storm sewer project as <br />proposed in the feasibility study. Mr. Tony Gleckel, attorney, <br />and Mark and Karen Cuff will be in attendance on May 29, 1990 to <br />discuss the matter. <br />To; Mayor Grabek & Orono Council Members <br />From: Mark E. Bernhardson, City Administrator <br />Forward recommending the Council continue with the offer as originally <br />proposed. This is in part based on the Council's action regarding <br />drainage issues in other areas of the City. <br />The Cuff's are not precluded from constructing a detached garage <br />by using a private solution of either a swale or piping. <br />If they desire to initiate a lawsuit, such would be referred to <br />the City's insurer.
