Briefly, the <br />applicant is requesting approval for excavating within an existing <br />small pond area. The conditional use permit is required because the <br />amount to be excavated exceeds 100 cubic yards. <br />At their April 16th meeting, <br />recommended approval, and <br />recommendation that the nature <br />comparison to the much larger <br />significant public benefit would <br />over this pond, hence Planning <br />that no easement need be taken. <br />Planning Commission unanimously <br />agreed with the City Engineer's <br />of this pond is relataively minor in <br />8-acre lake on the property. No <br />be protected by requiring an easement <br />Commission agreed with the Engineer <br />Recommended conditions of approval are as <br />Commission Action Notice of April 25th. <br />Staff RecoxBendations <br />shown on the Planning <br />Staff recommends approval per the recommendations of the City Engineer <br />and Planning Commission. A resolution for Council review is <br />attached.
