mm <br />C) The west boundary of the property abuts the RR-lB <br />rural residential zoning district. <br />D) Keeping horses on the property would not be <br />detrimental to the neighborhood and would have no <br />significant effect on neighboring properties, as long <br />as the horses are kept to the rear of the property and <br />housed in a suitable shelter. <br />E) The property is located approximately 900' from the <br />dredged channel abutting North Arm, and approximately <br />1,800' from the lake proper. Keeping of 2 horses on <br />the property will have no negative impact on the lake. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by staff and comments of the applicant <br />and the affect of the proposed use on the health, safety, <br />and welfare of the community. <br />5. The City Council finds that granting a conditional use <br />permit to allow the keeping of 2 horses on the property will <br />not be be detrimental to the health, safety or general <br />welfare of the public, would not adversely affect light, air <br />nor pose a fire hazard or other danger to neighboring <br />properties, nor will its use depreciate surrounding property <br />values and that the proposed level of use of the property <br />will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants a conditional use permit per Municipal <br />Zoning Code Section 10.20, Subdivision 3 (M & N) and Section <br />10.2' ubdivision 4 (A) to permit the keeping of up to 2 horses <br />on I 5.49 acre property located at 4590 North Arm Drive, <br />subjec :o the following conditions: <br />1. No pasture area or animal housing structure may be <br />located between the street lot line (south lot line) and the <br />front line of the house. <br />2. Up to 2 horses may be kept on the property in a <br />structure meeting the above noted location requirements as <br />well as other standard horse barn location requirements. <br />3. The existing garage/canopy structure located between the <br />house and North Arm Drive may not be used for housing <br />horses.
