A RBSOLOTION GRANTING <br />A CONDITIONAL USB PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.20, SUBDIVISION 3 (MAN) <br />AND SECTION 10.23, SUBDIVISION 4 (A) <br />FILE 11508 <br />WHEREAS, Donald Olson (hereinafter "the applicant") is <br />the owner of the property located at 4590 North Arm Drive within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />The South 854.50 feet of the West 280.00 feet of the <br />Southeast quarter of the Northwest quarter of Section 6, <br />Township 117N, Range 23W of the 5th principal meridian, <br />Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City of Orono <br />for a conditional use permit to permit the keeping of horses on a <br />property within the LR-IA Single Family Lakeshore Residential <br />zoning district per Municipal Zoning Code Section 10.20, <br />Subdivision 3 (M & N), and Section 10.23, Subdivision 4 (A). <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1508 <br />2. The property is located in the LR-IA Single Family <br />Lakeshore Residential Zoning District, in which the keeping <br />of domestic animals for non-commercial purposes is a <br />conditional use. <br />3. On April 16, 1990, the Orono Planning Commission <br />reviewed the application as proposed and recommended <br />approval on a vote of 4-2, based upon the following <br />findings: <br />A) Lot area is 5.49 acres, all of which is dry <br />buildable land. <br />B) The applicant is requesting permission to keep 2 <br />horses on the property. In Orono's rural zoning <br />district, only 4 acres would be required for keeping 2 <br />horses. <br />Page 1 of 4
