^4 <br />7^ <br />ۥ Th# City Council find* thnt tho conditions existing on <br />this property ere peculier to it a no do not epply general ly <br />to other property in this zoning rictj that granting the <br />variances would not adverselv -e t traffic conditions# <br />light, air nor pose a fire or other danger to <br />neighboring property; would not serely serve as a <br />convenience to the applicants# but are necessary to <br />alleviate a demonstrable hardship or difficulty; are <br />necessary to preserve a substantial property right of the <br />applicants; and would be in keeping with the soirit and <br />intent of the toning Code and Comprehensive P* 'u of the <br />City. <br />ooacuMtoii# ORMn m cohditiom <br />Based upon one or more of the findings noted above# the <br />Orono City Council hereby grants variances to Municipal Zoning <br />Code section 10.22# Subdivisions 1 and 2 and Section 10.55# <br />Subdi/ision 8 to permit the construction of a room addition <br />located entirely within the 0-75* lakeshore setback zone where no <br />hardcover or structure is normally allowed# subject to the <br />following conditions: <br />1. Hardcover in the 0-75* zone shall be reduced from he <br />existing 26.78% to a level of 18.8% by removal of existing <br />hardcover areas identified on Exhibit A attached# and these <br />areas shall revert to grass. Hardcover in the 75-250* <br />lakeshore setback zone shall likewise be decreased to 45.8% <br />as shown on Exhibit A. The site plan and hardcover <br />calculation basis for this apprc?val is attached as Exhibit A <br />to this resolution. <br />2. The applicants are advised that no future hardcover <br />increases on the property will be approved# and any future <br />proposal to increase hardcover on the property might be approved only in conjunction with concurrent removals of <br />pre-existing hardcover on the property# resulting in either <br />a net decrease or no net increase in hardcover on the <br />property. <br />3. Since the current proposal is for a 1 story addition at <br />this corner of the house# any future proposal to place a <br />second story above that addition will require a new variance <br />application. <br />4. Authorities granted by this resolution run with the <br />oroperty not with the applicants, but are permissive only <br />and must be exercised by application for a building permit <br />within one year of the date of Council approval# or this <br />variance will expire on that date (_ _ _ _ _ _ _ _ _ _).Page 3 of 5
