they were supportive. <br />5.Public Comment: <br />Written comments were submitted by neighbors, attached as Exhibit C. <br />6.Staff Recommendation: <br />Staff recommends a partial approval. The side setback variance to expand the mass of the home <br />upward with the 2nd story 5.3 feet from the neighboring property line is not reasonable. The <br />applicant should explore options that will not adversely impact the northern neighbors’ access to <br />sunlight and open space. <br /> <br />The hardcover proposed to serve the new, 2-car garage should be modified to accommodate the <br />required turnaround due to the access on Shadywood Road/CSAH 19 ( Section 78-1681). The <br />applicant should demonstrate that, as designed, the driveway will allow the space required to <br />maneuver vehicles to “front out” onto Shadywood Road. <br /> <br />The applicant asserts that their structural investigation indicated that the existing foundation and <br />existing first floor walls are sufficient to support the proposed 2nd story. If the variances are <br />approved, and it is determined that the addition requires reconstruction of the foundation and walls <br />for adequate support, the home could be rebuilt as is without variances and the addition <br />constructed at the existing setback. <br /> <br />Staff recommends approval of the hardcover variance resulting in a reduction, however further <br />recommends the applicant redesign the 2nd story addition to conform to the required setbacks. <br /> <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />The Council should review the applicant's request and practical difficulties regarding the requested <br />variances.
