Date: October 14, 2024 Item: 22 <br />Presenter: Melanie Curtis, Planner <br />Section: Community Development Report <br /> <br />Title: LA24-000043, 1760 Shadywood Rd, Variances <br /> <br /> <br />1.Purpose: <br />This application contemplates setback and hardcover variances in conjunction with a 2nd story <br />addition over the nonconforming home footprint and a garage addition. <br />2.MN§15.99 Application Deadline: <br />The application was submitted on August 19, 2024, and considered to be complete on September <br />5th. The 60-day review period will end on November 4, 2024. <br />3.Background: <br />The proposal involves removal of the existing garage which appears to be a detached structure but <br />is connected below ground to the home making is part of the principal building. Because it is part <br />of the principal building the garage's current 6.4 foot rear yard setback is nonconforming. <br /> <br />The applicant proposes to remove the existing garage and construct a new attached garage within <br />conforming setbacks. A 2nd story addition is proposed to be constructed over the new, expanded <br />home's footprint 5.3 feet from the north side property line and about 2.5 feet lakeward of the 75- <br />foot and average lakeshore setbacks. The applicant is requesting the following variances in order <br />to proceed with the major remodel of the home: <br />A side yard setback variance to permit a 2nd story setback 5.3 feet from the property line, <br />above the home at the existing nonconforming setback; <br />Average lakeshore setback variance to allow the 2nd story of the home to encroach 2.5 feet <br />lakeward of the ALS over the existing footprint; <br />75-foot lake setback variance to allow the 2nd story of the home to encroach approximately <br />2.5 feet into the lake setback over the existing footprint; and <br />A hardcover variance to support the project including a footprint addition and reorientation <br />of the driveway resulting in a reduction: 27.7% hardcover where 29% exists and 25% is <br />permitted. <br /> <br />A detailed summary and analysis of the variances is included in the Planning Report. <br />4.Planning Commission Vote and Comment: <br />On September 16th, the Planning Commission held a public hearing on the above variances. <br />The neighbors on the north side of the property provided comment during the public hearing. <br />Following the public hearing and discussion, the Commission voted 4 - 2 on a motion to approve <br />as applied. Commissioners Erickson and Libby cast the dissenting votes as they did not support the <br />upward massing expansion in the setback areas. <br /> <br />The four Commissioners in favor identified the resolution of the nonconforming rear yard setback <br />as one of the factors supporting their approval recommendation.
