Approval - If approvod, the Planning Commission may consider one <br />or more of the following findings: <br />1. The creation of the outlots has no negative impact on <br />the tested septic sites» nor created a need for lot standard <br />variances for the 17 residential lots. <br />2. The tennis court does not require s .tback variances. <br />3. With the creation of Oulot B, the Developer has provided <br />future septic expansion area for the substandard residential <br />unit surrounded by the subdivision. <br />4. Outlots A and B are not considered bulldable lots. <br />Out lot A shall be jointly owned by an association of 17 <br />homeowners for the exclusive use of those owners and guests. <br />Applicant shall provide appropriate covenants for the <br />maintenance of the accessory structure and grounds. <br />Out lot B shall be set aside for acquisition for either <br />the current or future owner of the developed residential lot <br />to the imn-ediate east of the outlot for future septic <br />expansion. <br />Developer shall execute a special covenant de <br />special use and restrictions on both outlots. <br />*.ng the <br />The approval of this subdivision is subject to the following <br />conditions: <br />1. Use of the tennis court on Outlot A shall be limited to <br />the hours of a.m. to _ _ _ p.m. and to be limited to <br />the use of the owners within the Fox Bend Subdivision and <br />their guests. <br />2. No outdoor lighting is approved for Outlot A. <br />3. No other accessory structures are approved for Outlot A. <br />4. Other conditions deemed appropriate by the Planning <br />Commission for the future use of Outlot A or Outlot B. <br />J
