CITY OF ORON -j"- <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 6 52 9 <br />lake setback variances allowing for the construction of the proposed second story <br />improvements to the home; and to deny of the portion of the requested lake setback <br />variance to allow further structural encroachments within the 75 foot setback; based on <br />the following findings: <br />a). The Property contains 7,265 square feet in area and has 52 feet in width at the <br />OHWL and 53 feet in width at the 75 foot setback. <br />b). The variance to allow construction of the second story addition on the Property <br />which is substandard with respect to area and width will alleviate a practical <br />difficulty inherent to the Property and was not created by the Applicants. <br />c). The Applicants' proposal results in a minor decrease in hardcover from 49.7% <br />to 4.93% where 25% is the maximum permitted for a Tier 1 property; the <br />proposed structural coverage exceeds the permitted 1,500 square feet by 728 <br />square feet. The Applicants' proposal reduces structural coverage by 25 square <br />feet. <br />d). The proposed setbacks do not exceed beyond the existing footprint and are not <br />out of character with the neighborhood. <br />e). The Applicants are proposing changes to the existing home which will eliminate <br />the existing average lakeshore setback encroachment. <br />f). The variance to construct a second story addition to the residence is in harmony <br />with the general intent and purpose of the Ordinance. <br />g). The variance to permit improvements to the existing residence in a residential <br />district is consistent with the comprehensive plan. <br />h). The Applicants have provided a survey reflecting the limited building envelope <br />on the Property which is substandard lot area and lot width establishing that <br />there are practical difficulties. <br />i). The Applicants propose to use the property in a reasonable manner not <br />permitted by the official controls; <br />j). The circumstances unique to the Property were not created by the landowners. <br />k). Approximately half of the existing home footprint exists in a nonconforming <br />location; construction of a second story in a permitted location is limited by the <br />Page 2 of 5 <br />
