C s �"Y OF OROI' O <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 6529 <br />A RESOLUTION GRANTING <br />SETBACK VARIANCES <br />FROM ORONO MUNICIPAL CODE <br />SECTIONS 78-350 & 78-1279 <br />FILE NO. 15-3760 <br />WHEREAS, Jeff Von Feldt and Elaine Wyatt, a married couple, (hereinafter <br />the "Applicants) are the owners of the property located at 1990 Shadywood Road within the <br />City of Orono (hereinafter "City") and legally described as: Lot 40, Shady -Wood, Hennepin <br />County, Minnesota (hereinafter "the Property"); and <br />WHEREAS, the Applicants have made application to the City for a variance <br />from Orono City Code Section 78-350 to permit construction of a second story over the existing <br />home as close as 7 feet from the north side property line where a 10 foot setback is required; <br />and <br />WHEREAS, the Applicants have made application to the City for a variance <br />from Orono City Code Section 78-350 to permit construction of a second story over the existing <br />home as close as 21 feet from the rear property line where a 30 foot setback is required; and <br />WHEREAS, the Applicants have made application to the City for a variance <br />from Orono City Code Section 78-1279 to permit construction of a second story over the <br />existing home as close as 65 feet from the ordinary high water level (OHWL) of the lake where <br />a 75 foot setback is required; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br />held a public hearing on June 15, 2015, at which times all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />1. This application was reviewed as Zoning File #15-3750. <br />2. The Property is located in the LR -1C One Family Lakeshore Residential Zoning District <br />which requires a minimum lot area of 0.5 acres and a minimum lot width of 100'. <br />The Planning Commission reviewed this application on June 15, 2015, the Planning <br />Commission voted 6 in favor and 0 opposed on a motion to: approve side, rear and <br />Pagel of 5 <br />
