Subd. 21. Special Requirements for Class II and III <br />Subdivisions. <br />A. Improvements. All public and/or private <br />improvements required by the City to be completed by the subdivider <br />prior to Final Plat approval, shall be fully completed and shall <br />have had a certificate of satisfactory completion issued by the <br />City Engineer prior to endorsement of the Final Plat by the City. <br />All public and/or private improvements required by the City to be <br />completed by the subdivider after Final Plat approval shall be <br />fully set forth in a subdivider's agreement to be executed prior to <br />Final Subdivision approval. All local streets in subdivisions <br />where sewer and water are not available shall be private unless <br />otherwise approved by the City at preliminary subdivision approval. <br />The City reserves the right to determine whether a road is to be <br />public or private in all areas of the City. <br />B. Public Roads. Public streets and roads will be <br />required to be platted, constructed and dedicated to the City when <br />required by the Council consistent with the recommendations of the <br />Planning Commission and the City staff and the established City <br />oractices and design standards. Public roads shall be completed <br />and issued a certificate of satisfactory completion oy the City <br />Engineer prior to Final Plat approval or, when specifically <br />authorized by the Council, shall be subject to the conditions of a <br />subdivider's agreement to be executed prior to Final Plat approval. <br />#■1^0. Private Roads. When the Preliminary Plat has <br />been aporov^ on the basis of a private access road providing the <br />only access to three or more lots, the private road shall be <br />identified on the Final Plat as a separate outlot. The private <br />road shall be identified by name if the road serves four or more <br />lots. Whenever a private road outlot is proposed, the subdivider <br />shall be required to provide for a permanent homeowner|s <br />association or road maintenance agreement acceptable to the City in <br />order to insure ownership and maintenance of the road outlot. <br />D. Road and Utilities Basements. The Council may, <br />upon recommendation of the Planning Commission and/or City staff, <br />require the sut divider to convey to the City certain road and <br />utilities easements permitting public ingress, egress and access <br />over orivate roads as a condition of Final Subdivision approval. <br />1. Whenever a private access road is <br />authorized, the required outlot shall be included on and conveyed <br />in a road and utilities easement in the standard City form. <br />2. Whenever areas of the plat are to be set <br />aside for public or private utility construction and use, said <br />areas shall be described and dedicated for public use on the plat. <br />This shall include areas shown on record plat drawings as "drainage <br />and utilities easements". .... >3. Whenever a road and utilities easement is <br />required, the easement shall be fully executed prior to Final Plat <br />approval using the legal descriptions of the Final Plat and shall <br />thereafter be filed in the chain of title of the property <br />concurrent with the filing of the Final Plat. <br />442 (4-1-84)ORONO CC
