� O� <br /> O a_ O CITY of ORONO <br /> ���z,_ <br /> � �' �► RESOLUTION OF THE CITY COUNCIL <br /> '� ::�z :; <br /> � �,�� No. 6762 <br /> L�kESH�g'� <br /> the variance would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the Applicants, but is necessary to alleviate a practical difficulty; <br /> is necessary to preserve a substantial property right of the Applicants; and would <br /> be in keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> variance from Orono Municipal Zoning Code Section 78-330 to allow construction of a new <br /> residence on an existing lot with 100 feet in width at the OHWL and 100 feet in width at the 75- <br /> foot setback where 140-feet in width at both setbacks is normally required; and a variance from <br /> Orono Municipal Zoning Code Section 78-1288 to allow 6,740 square feet or 38.5% hardcover <br /> within the 75'-250' zone where 25% is normally allowed in conjunction with the construction of a <br /> new residence, subject to the following conditions: <br /> 1. Council approval is based on the survey and building plans submitted by the Applicants <br /> and annotated by City staff, attached to this Resolution as Exhibits A and B. Any <br /> amendments to the plans which are not in conformity with City codes will require further <br /> Planning Commission and City Council review. <br /> 2. Hardcover shall not increase above the approved levels as follows: 1.7% hardcover <br /> within the 0-75' zone for an existing boat house; 6,740 square feet (38.5%) of hardcover <br /> within the 75' to 250' zone; and 3,460 square feet (16.5%) hardcover within the 250' to <br /> 500' zone. <br /> 3. The Applicants' building permit survey and plans shall address the city engineer's <br /> comments and recommendations. <br /> 4. The home plans submitted are for the purpose of hardcover review. The construction <br /> plans and survey submitted for building permit will be reviewed for conformance with <br /> Orono's building height and number of stories calculation. <br /> 5. Authorities granted by this resolution run with the Property not with the Applicants, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. A framing inspection must be <br /> completed within one year of the date of Council approval, or the variance will expire on <br /> that date (August 27, 2013). <br /> Page 3 of 5 <br />
