The Property has 46,000 square feet (1.05 acre) in area and 100 feet in width <br /> at the OHWL and 100 feet in width at the 75-foot setback where 43,560 <br /> square feet (1.0 acre) in area and 140-feet in width are normally required. <br /> b. Sanitary sewer and City water are available. <br /> c. There is no additional land available to bring the lot width into conformity. <br /> d. The Planning Commission finds that a residential structure can be built on the <br /> Property without the need for a hardcover variance. <br /> 4. The City Council finds that the following factors support the granting of a <br /> hardcover variance: <br /> a. The Applicants' proposal results in an overall total reduction in hardcover <br /> from the current levels by over 2,000 square feet within the 75' to 250' zone; <br /> and by 7,040 square feet within the 250' to 500' zone on the property. <br /> b. The Applicants' plan results in 22.4% overall hardcover for the entire site. <br /> c. The Applicants' request will alleviate a practical difficulty inherent to the <br /> Property and not created by the Applicants. <br /> d. The Applicants' request will not alter the essential character of the <br /> neighborhood and will result in minimal negative impact on adjacent <br /> properties. <br /> e. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> f. The Applicants have demonstrated that enforcing the 75' to 250' zone <br /> hardcover and lot width provisions of the Zoning Ordinance deprive the <br /> Applicants of the reasonable use of their Property. <br /> 5. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 6. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> Page2of5 <br />
