The City finds that raising environmental awareness of students by <br /> utilizing actual outdoor locations for hands on experience is in keeping <br /> with the City's environmental goals and policies, and that providing <br /> accessibility to the lakeshore and wetlands adjacent to the school campus <br /> for public educational purposes is appropriate and meets the criteria for <br /> establishing a practical difficulty. <br /> c. Per the recommendations of the City's Wetland Specialist, establishment of <br /> wetland buffer areas adjacent to the edge of the wetland in the area of the <br /> proposed pavilion would be preferable to the proposed location of such <br /> buffers behind the pavilion, and will mitigate the impact of structure within <br /> the required buffer axea. <br /> 4. The City Council considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the Applicant and the public, and the effect of the proposed <br /> conditional use and variances on the health, safety and welfare of the <br /> community as well as the impact on properties in the vicinity. <br /> 6. The City Council finds that the conditions existing on this Property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variances and conditional use permit would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard or other <br /> danger to neighboring property; would not merely serve as a convenience to <br /> the Applicant, but is necessary to alleviate a practical difficulty; is necessary to <br /> preserve a substantial property right of the Applicant; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants <br /> variances to Orono City Code Sections 78-1279 and 78-1605 to construct an open-sided 924 <br /> square foot pavilion with a 330 square foot deck to be located approximately 85 feet from the <br /> OHW of Lake Classen where a 150 foot structure setback is normally required and 5 feet <br /> from the delineated wetland edge where a 70 foot wetland buffer and buffer setback would <br /> normally be required; and grants variances to Sections 78-1279 and 78-1605 to construct two <br /> Page 3 of 5 <br />
