� o� <br /> O � O CITY of ORONO <br /> �,��, _ <br /> �-1 �' ; .4, � RESOLUTION OF THE CITY COUNCIL <br /> �� � .:�`� G ti N o. 6 � 3 4 <br /> ��kESH�4'� <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #12-3548. <br /> 2. The City's Wetland Specialist has reviewed the plans and has made a number <br /> of recommendations regarding buffers to mitigate the impacts of the proposed <br /> pavilion/deck structure. <br /> 3. The walkways and platforms along the shoreline are an allowed use in the <br /> wetland buffer per Code Section 78-1606(b)(3) but require a variance because <br /> these wetlands are located along the shoreline. <br /> 4. The Planning Commission reviewed this application on March 19, 2012 and on <br /> a vote of 6 - 0 found that with conditions the application will satisfy the <br /> requirements for granting of the requested variances and conditional use <br /> permit: <br /> a. The Applicant will provide evidence of the appropriate MCWD approval <br /> prior to issuance of City building permits for the project. <br /> b. The Applicant will apply for and receive the appropriate building permits <br /> prior to commencement of the pavilion project and prior to construction of <br /> additional observation platforms. <br /> c. The Applicant will provide an erosion control plan and final buffer <br /> mitigation plan to be approved administratively prior to issuance of <br /> building permits. <br /> 5. The City Council makes the following additional findings regarding this <br /> application: <br /> a. The requested variances and CUP are necessary for the provision of <br /> educational resources vital to the Orono School District's Environmental <br /> Learning Program, and play a key role in the school's academic programs <br /> including science, art and environmental systems. <br /> Page 2 of 5 <br />
