O O CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ? ti� NO. 6 <br /> `9$ES1404�' <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> TO ORONO MUNICIPAL CODE <br /> SECTIONS 78-305, 78-1279 & 78-1288 <br /> AND <br /> A CONDITIONAL USE PERMIT PURSUANT TO <br /> ORONO MUNICIPAL CODE SECTIONS 78-966, 78-967 & 78-1286 <br /> TO ALLOW LAND ALTERATION WITHIN THE LAKESHORE SETBACK <br /> FILE NO. 12-3540 <br /> WHEREAS, The Estate of Ralph Colt Bagley (hereinafter "Owner") is the <br /> owner of the property located at 1105 Ferndale Road West within the City of Orono <br /> (hereinafter "City") and legally described as: Tracts A and C, Registered Land Survey No. <br /> 902, Files of Registrar of Titles, County of Hennepin and Tract A, Registered Land Survey , <br /> No. 441, Files of Registrar of Titles, County of Hennepin, except that part embraced in t <br /> Registered Land Survey No. 902, Registrar of Titles, County of Hennepin. Registered <br /> Property as evidenced by Certificate of Title No. 645075, Hennepin County, Minnesota <br /> (hereinafter"the Property"); and <br /> WHEREAS, Charles L. Truwit and Paula J. Picard, a married couple <br /> (hereinafter the "Applicants") have an interest in the Property; and <br /> WHEREAS, the Applicants have made application to the City for variances to <br /> Orono Code Section 78-305(b) to construct a replacement residence on a lot with an area of <br /> 0.63 acres and a defined width of 0 feet when 2.0 acres and 200 feet of width are required; <br /> and <br /> WHEREAS, the Applicants have made application to the City for variances to <br /> Orono Code Section 78-305(b) to construct a replacement residence on the Property with a <br /> side setback of 5 feet when a 30 foot setback is required; and <br /> WHEREAS, the Applicants have made application to the City for a variance to <br /> Orono Code Section 78-1279 to construct a replacement residence on the Property with a <br /> lake setback of 10 feet when a 75 foot setback is required; and <br /> WHEREAS, the Applicants have made application to the City for a variance to <br /> Orono Code Section 78-1288 to construct a replacement residence on the Property with <br /> 9,619 square feet or 36% hardcover in the 0 to 75 foot zone when no hardcover is allowed; <br /> and <br /> Page 1 of 6 <br />
