<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7496 <br /> <br /> <br />2 <br /> <br /> WHEREAS, on August 12, 2024, the City Council considered the request <br />for an interim use permit and to vacate the Easement; and <br /> <br /> WHEREAS, the City Council has reviewed the application, the public input, <br />the recommendations of the Planning Commission, and City staff; and <br /> <br /> WHEREAS, following the hearing and consideration of the proposed <br />vacation, the Council has determined that it is in the public interest to vacate the <br />Easement as it affects the Subject Property and grant the interim use permit. <br /> <br />WHEREAS, the City Council finds that vacation of the Easement is in the <br />interest of the public. The new dedication of a drainage easement over the new <br />stormwater pond will meet the stormwater standards for the affected area ; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Orono, <br />Minnesota that the Easement as it affects the Subject Property is hereby vacated and <br />approves the requested IUP as described above based on one or more of the following <br />findings of fact concerning the Property: <br /> <br />FINDINGS OF FACT: <br /> <br />1. The analysis contained within staff memos and the exhibits attached to the <br />aforesaid memos, all minutes from the above-mentioned meetings, and all other <br />materials distributed at these meetings are hereby incorporated by reference. <br /> <br />2. The Property is located in the LR-1A, One Family Lakeshore Residential Zoning <br />District. <br /> <br />3. The Applicants have applied for an IUP for grading and to vacate an existing <br />drainage easement. <br /> <br />4. In considering this application for an IUP, the Council has considered the advice <br />and recommendation of the Planning Commission and the effect of the proposed <br />IUP upon the health, safety and welfare of the community, existing and <br />anticipated traffic conditions, light and air, danger of fire, risk to the public safety, <br />and the effect on values of property in the surrounding area. <br /> <br />INTERIM USE PERMIT ANALYSIS: <br />96
