<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7496 <br /> <br /> <br />1 <br /> <br />A RESOLUTION APPROVING <br />AN INTERIM USE PERMIT PURSUANT WITH <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-916 & 78-1726 AND VACATING A DRAINAGE EASEMENT <br />DEDICATED WITH THE PLAT FULLERTON ESTATES <br />HENNEPIN COUNTY, MINNESOTA <br /> <br />FILE NO. LA24-000027 <br /> <br />WHEREAS, the City of Orono is a municipal corporation organized and <br />existing under the laws of the State of Minnesota; and <br /> <br /> WHEREAS, on June 12, 2024, Bruce Boeder o/b/o SF Real Estate LLC., <br />(hereinafter the “Applicant”), applied for and interim use permit (IUP) for grading and a <br />vacation of a drainage easement (the “Easement”) over an existing stormwater pond at <br />3295 Fox Street within the plat of Fullerton Estates over property legally described <br />(hereinafter "Subject Property''); as <br /> <br />Lot 1, Block 1, Fullerton Estates, Hennepin County Minnesota <br /> <br /> WHEREAS, the Applicant’s request includes an interim use permit pursuant <br />to Orono Municipal Zoning Code Sections 78-916 and 78-1726 to allow for over 70,000 sq.ft of <br />disturbance to happen within the Shoreland Overland District where 10,000 sq.ft is allowed <br />in order to fill an existing stormwater pond and construct a new stormwater pond in a new <br />location; and <br /> <br />WHEREAS, the Applicant’s request includes dedication of new easement <br />area over a new proposed stormwater pond located on 3345 Fox Street; and <br /> <br /> WHEREAS, on July 15, 2024, after published and mailed notice in <br />accordance with Minnesota Statutes and the City Code, the Planning Commission held a <br />public hearing, at which time all persons desiring to be heard concerning this application <br />were given the opportunity to speak thereon; and <br /> <br /> WHEREAS, on July 15, 2024, the Planning Commission voted 6 to 0 in favor <br />of a motion to approved the requested application vacations of the Conservation <br />Easement; and <br /> <br />95
