. � °� <br /> O � O CITY of ORONO <br /> ,�,� - <br /> �-1 : �' � RESOLUTION OF THE CITY COUNCIL <br /> �'� �� �� No. 63 � 3 <br /> ��kESH�g'� <br /> required; and grants a CUP pursuant to Orono Municipal Zoning Code Section 78-565(2) to <br /> allow an existing 700 square foot guest cabin to remain in use on the Property following <br /> construction of the new 2,400 square foot seasonal cabin where an accessory guest cabin not <br /> exceeding 600 square feet is permitted; subject to the foilowing conditions: <br /> 1. Council approval is based on the survey and building pfans submitted by the App(icants <br /> and annotated by City staff, attached to this Resolution as Exhibits B & C. Any <br /> amendments to the approved plans which are not in conformity with City codes will <br /> require further Pianning Commission and City Council review. <br /> 2. Proposed hardcover leveis are conforming to the Tier 1 standards; no hardcover <br /> variances are granted. <br /> 3. The Applicants by agreeing to the provisions of this Resolution do hereby covenant that <br /> the 700 square foot accessory guest cabin wili be used solety by the occupants of the <br /> new 2;400 seasonal cabin, including their domestic employees, caretakers or nonpaying <br /> gues:s. The 700 square foot accessory cabin shall not be rented or leased for <br /> compensation. <br /> 4. The Property shall be subject to strict showing of compliance with health and sanitation <br /> performance standards. <br /> 5. The 700 square foot accessory guest cabin and the 2,400 square foot seasonal cabin <br /> shall all be connected to on-site sewage treatment systems in conformance with the <br /> requirements of section 78-574. <br /> 6. The 700 square foot accessory guest cabin and the 2,400 square foot seasonal cabin <br /> shall all be equipped with approved smoke detection devices and with some form of <br /> manual or automatic fire extinguishing equiprnent. <br /> 7. Copies of Minnehaha Creek Watershed perrnits; if required, shall be provided to the City <br /> prior to the issuance of the building permit. <br /> 8. An as-built grading plan/survey showing conformance with the approved plan shall be <br /> submitted prior to the final inspection of the site grading. Vegetation must be established <br /> and final grading must be approved prior to the refease of escrow monies. <br /> 9. Authorities granted by this resolution run with the Property not with the Applicants, but <br /> are permissive only and must be exercised by obtaining a permit for the new 2,400 <br /> seasonal cabin and commencing construction of said project within one year of the date <br /> of Council approval, or the variances and CUP will expire on that date (April 14, 2015). <br /> Page 4 of 6 <br />
